The Commission takes enquiries, handles complaints and provides training about discrimination, sexual harassment and victimisation.
The Board may have a role when a person is unable to make certain important decisions for themselves due to having a mental incapacity. The Board can make Administration Orders, Guardianship Orders and Orders giving consent to treatment. The Board also hears appeals under the Mental Health Act, and makes orders for involuntary inpatient care and community treatment of people with a mental illness.
Health & Community Services Complaints Commissioner
Helps service users, carers and service providers resolve complaints about health and community services, including child protection services, when a direct approach to the service provider is either unreasonable, or has not succeeded.
Office of the Public Advocate (OPA)
The OPA aims to promote and protect the rights of people with mental incapacity in South Australia. When a guardian is needed to make lifestyle and medical decisions for a person with a mental incapacity, and there is no other appropriate person to be appointed, the Guardianship Board can appoint the Public Advocate as guardian of last resort. The OPA can also investigate the circumstances of a person who is believed to have a mental incapacity and is at risk in some way. The OPA can undertake systems advocacy and make recommendations to the Minister for Health, the Minister for Social Justice and the Attorney-General for legislative and operational change.
Ombudsman South Australia
Ombudsman SA is independent and investigates complaints about South Australian government and local government agencies.
